By using any part of this Website, registering, placing an order and purchasing products from MintArts.com, you agree to be bound into a legally binding agreement with us with the following terms and conditions. Please read these conditions as they affect your rights and liabilities.



1. Introduction

MintArts.com (thereafter the “Website”) is run by Mint Art Gallery Ltd. (“MintArts”, “we”, “us” or “our”) and provides the products and services available on the Website. Our correspondence address is 58 Twyford Avenue, London N2 9NL, United Kingdom and our company registration number is 7777781.



2. Use of Website

  • Service: We endeavour to ensure the smooth service of the Website and that it is error-free. However, this cannot be guaranteed due the nature of internet service providers. Please be aware that the Website or parts of it may occasionally be suspended or restricted for emergency repairs, updates and maintenance without prior notification.

  • Privacy: Please review our Privacy Policy which explains how we use the information you provide on the Website for your assurance.

  • Accuracy: Any information that you provide when you register or make a purchase must be true, accurate and current. If your personal information changes, please notify us immediately.

  • Language: The contract between you and us shall be concluded in English.

3. Description of products and accuracy of information

We try to ensure that the content and information on the Website are correct at the time of posting. Unfortunately we cannot guarantee this at all times and any person using information contained in the Website does so entirely at their own risk.

We take all reasonable care to ensure that all details, descriptions and prices of products are correct at the time and point of sale. Although we aim to keep the Website as up-to-date as possible, the information such as availability may not always reflect the position exactly at the moment you place an order. However, we cannot confirm the price or availability of a product until your order is accepted.

With images on the Website, please note that colours and detail as they appear on-screen may not be the exact representative of what they actually are and may vary according to your individual computer settings. This could also be due to the fact that most of our products are hand-produced, hand-printed or hand-glazed which makes each item slightly different and individualised.



4. Pricing

The prices of the products are as set out in the Website. When we accept an order from you, the price for the product will be the price set out at the time the order is placed. We reserve the right to change the price, and add or remove discounts at anytime.

The product price is only for the item and does not include postage and packing. There will be a delivery charge made relative to the size, weight and number of items ordered. Delivery charges are clearly shown as soon as items are place in the shopping cart.



5. Orders

We shall sell to you the quantity, description and specifications of those products which you have set out in your order which has been accepted by us. Once you have placed your order, we will acknowledge it with an email reply. The email will confirm details of your purchase and the approximate dates that we will despatch your order. Once products are despatched from our office, we will send you another email.

Orders are accepted at our sole discretion and we reserve the right to reject or cancel any order at any time. This may be due to the products being out of stock, inability to obtain authorisation for your payment, any errors in pricing or product information, or other circumstances. If we are unable to fulfil your order following our order acknowledgement, we will contact you by email, post or telephone advising you of this.



6. Payment

You must pay us the full price of your order before we send any part of it. Banking charges will be borne by us. All other charges relating to payment in a currency other than Sterling pound will be borne by you. Any details given by us in relation to exchange rates are approximate only and may vary from time to time.

We will retain the legal ownership of the products until full payment has been made by you and payment received by us. Legal ownership of the products will immediately revert to us if we refund any such payment to you.



7. Delivery

  • Time: We endeavor to fulfilled orders within 5 working days when possible for all in-stock works. We will do all we can to meet the date given for delivery but we cannot be held responsible for delays beyond our control. If we are unable to make the delivery date we will contact you. If delivery cannot be made within 30 days of the given delivery date you will be entitled to either arrange a revised date or cancel the order and receive a full refund. If we are able to make delivery in advance of the given date we will contact you.

  • Multiple items: If your order is for multiple items and we are unable to deliver the whole order at one go, we will part deliver the items in instalments and will inform you of this. Each delivery shall constitute a separate contract and any failure by us to deliver
    any one or more of the instalments in accordance with these conditions, or any claim by you in respect of any one or more instalments will not entitle you to treat the contract as a whole as repudiated.

  • Fees: Delivery fees include handling and packing as well as postage costs. Handling fees are fixed, whereas transport fees vary according to total weight of the shipment.

  • Responsibility: As we are dealing with art objects, we will endeavour to wrap and box all items to ensure that they are well-protected during shipment. Please check your products upon receipt. Delivery of your products will be despatched at your own risk to
    the delivery address in accordance to the delivery instructions in your order form. Once your order has been delivered, you will be responsible for them. Our responsibility for
    everything other than damage due to our negligence will cease upon delivery. If you delay a delivery, our responsibility will end on the date we agree to deliver them.

  • If we fail for any reason to fully or partially deliver your order, any reimbursement shall be no more than the price of the products and any delivery cost you paid for the full/instalment delivery.

  • 

8. Cancellation and returns 

Should you decide that our products do not meet your requirements, you may have the right to cancel and return your orders. If you do, the following terms apply:

  1. *  You must inform us of your wish to cancel and the reason for cancellation within 7 days of your receipt of the items. If no such action is taken, we shall not be obliged to accept any rejection of the products at a later date.
  2. You may not cancel orders for specially commissioned or personalised items. These also include customised frames.
  3. The items must be returned to us within 14 days of delivery with both items and packaging in their original condition and securely packed.
  4. Items returned will be at your own risk and cost. If we do not receive the return items, you are still liable to us for the cost. We suggest that all returns be sent registered and insured.
  5. Once we have received the returned items, we will credit your account with the full purchase price of the items no later than 30 days from the date of receipt of the return. Please note that we cannot refund the delivery costs under any circumstances except when it is our error in delivering the wrong order.
  6. We are under no obligation to collect or recover items from you, but if we do, costs will be payable by you.

If you wish to cancel your order before it has been despatched, email us immediately. Please provide your customer order number and the date of your order. Orders are generally processed immediately, so we may have already prepared your order and arranged for it to be despatched. Depending on the timing of your request, we may not be able to stop the order from being sent. If this is the case, once you receive the product(s) you will have to return them to us in accordance with the above returns policy. We will be unable to refund the delivery cost once orders are despatched.



9. Commission

All artists on the Website are available for special made-to-order commissions. Please contact us at info@mintarts.com stating your interest.



10. Feedback and complaints

We appreciate any feedback and criticism you may have in respect of the products and services we provide. Please don’t hesitate to email us via the contact us link.



11. Intellectual Property

All content made available through this Website including but not limited to, text, graphics, logos, trademarks, button icons, images, audio/video clips, data compilations, and other compilation (thereafter known as the “Content”) is the property of Mint Art Gallery and our artists, and is protected by UK and international copyright and other similar laws.

No Content or any other portion of the Website can be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in full or in part, for any purpose without our prior written consent.



12. Third Party Links

We assume no responsibility for the content, accuracy or reliability of any other websites linked to or from the Website. Links appearing on the Website are not an endorsement by us, or our artists. Your linking to or from other websites is at your own risk.

 

13. Disclaimer

By using the Website, you agree defend, indemnify, and hold harmless MintARTS.com/Mint Art Gallery, its officers, directors, employees, agents, and third parties, against any and all costs, expenses, losses or damages (including legal fees) arising out of any claims, including any violation of these rules.

We provides this Website on an “as-is” basis without warranty of any kind including the implied warranty of satisfactory quality. This Agreement is entered into in United Kingdom and shall be governed by, and shall be constructed in accordance with British Law. The courts of England and Wales shall have jurisdiction to hear and determine any cost, action or proceedings, and to settle any disputes which may arise out of or in connection with these rules and you irrevocably submit to the jurisdiction of such courts.
